1. Agreement
By visiting this website, downloading Manafall, joining linked community spaces we operate for the game, or using Manafall tools that connect to third-party platforms (including social posting tools used for the official Manafall TikTok account), you agree to these Terms. If you do not agree, do not use the site or those services.
2. What Manafall provides
Manafall is an indie multiplayer survival game and related materials (trailers, patch notes, Discord community links, optional support via Ko-fi, and marketing tools). The website may offer a free Windows build and links to itch.io, Discord, YouTube, Ko-fi, and other third-party services. Features and availability may change as the game develops.
3. Eligibility
You must be able to form a binding agreement where you live. If you are under the age required for online accounts or game platforms in your region, you may use Manafall only with a parent or guardian’s permission where required by law.
4. License to the game
When you download Manafall from this site or an official listing we authorize (such as itch.io), we grant you a personal, non-exclusive, non-transferable, revocable license to install and play the game for personal, non-commercial use, subject to these Terms and any platform rules that apply.
You may not sell, rent, reverse engineer (except where law forbids that restriction), redistribute unofficial builds as if they were official, cheat in ways that harm other players, or remove copyright notices.
5. Accounts and multiplayer
Online or multiplayer features may require display names or other identifiers. You are responsible for activity under your connection. We may suspend access that disrupts servers, harasses players, exploits bugs maliciously, or violates these Terms.
6. User conduct
In Manafall spaces we operate (including Discord linked from this site), you agree not to:
- Harass, threaten, or abuse others
- Post illegal content or malware
- Spam, scam, or impersonate the creator or staff
- Share others’ private information without consent
7. Intellectual property
Manafall, its name, art, audio, code, lore, branding, and this website are owned by Jean-Luc Alexander or used under license. These Terms do not transfer ownership to you. Feedback you send may be used to improve the game without obligation to you.
8. Third-party services
Links to itch.io, Discord, YouTube, Ko-fi, TikTok, GitHub, and similar services are provided for convenience. Those services have their own terms and privacy policies. We are not responsible for their content, outages, or billing. Optional tips go through Ko-fi; this site does not collect card numbers.
Manafall Content Studio and related developer integrations may post or manage content on official Manafall social accounts (such as TikTok) only with authorization from the account owner. They are not a public social-media manager for other people’s accounts unless we expressly offer that.
9. Downloads and updates
Builds may be large, experimental, or incomplete. Patches may change or remove features. We do not guarantee uninterrupted availability of download links or servers.
10. Disclaimers
THE SITE, GAME, AND RELATED TOOLS ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, TO THE FULLEST EXTENT PERMITTED BY LAW.
11. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, JEAN-LUC ALEXANDER AND MANAFALL WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SITE, GAME, OR RELATED TOOLS. OUR TOTAL LIABILITY FOR ANY CLAIM WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US DIRECTLY FOR THE PRODUCT GIVING RISE TO THE CLAIM IN THE TWELVE MONTHS BEFORE THE CLAIM, OR (B) FIFTY U.S. DOLLARS (US$50). SOME REGIONS DO NOT ALLOW CERTAIN LIMITATIONS; IN THOSE REGIONS OUR LIABILITY IS LIMITED TO THE MAXIMUM ALLOWED.
12. Indemnity
You agree to defend and hold us harmless from claims arising out of your misuse of the site or game, your violation of these Terms, or your violation of others’ rights, to the extent allowed by law.
13. Changes
We may update these Terms by posting a new version on this page with a revised “Last updated” date. Continued use after changes means you accept the updated Terms.
14. Termination
We may suspend or end access to downloads, multiplayer, or related tools if you breach these Terms. Sections that should survive (including IP, disclaimers, and liability limits) will survive.
15. Governing law
These Terms are governed by the laws applicable in the creator’s place of residence, without regard to conflict-of-law rules, except where mandatory consumer laws in your country say otherwise.
